Not all commercial mediations arise when parties have fallen out, are in dispute, have sued each other or are thinking of suing each other. Circumstances do arise where people realise they are better off together than apart, yet are unable to manage the balance of risk and reward in their contract renewal, joint venture, or basic terms of co-existence.
